Commercial Manager - Project Services


The Kinross Corporate Head Office is located in downtown Toronto and supports Kinross' operations and projects worldwide. Corporate functions include Finance, Procurement, Health & Safety, Human Resources, IT, Investor Relations, Exploration, Geology and Mine Planning, among others.

JOB DESCRIPTION
The Commercial Manager will lead the planning, solicitation, negotiation, and management of contracts for complex services and engineered equipment required by capital projects of significant strategic importance to the Company. 

The Commercial Manager will provide and implement standard industry best practices in all aspects of sourcing, purchasing, and contract administration, including the preparation, review, and issue of contractual documentation and the implementation of effective commercial measures to facilitate the efficient and well-controlled execution of the work under contract.  The Commercial Manager will ensure that practices are in place to identify and minimize liabilities and commercial risks to Kinross including the avoidance of disputes and timely resolution of commercial claims. 

The Commercial Manager will be required to work within a variety of project delivery modalities including owner-managed, EPCM-led, and hybrid projects.

Depending on the requirements of the organization the Commercial Manager may, from time to time, be either project-dedicated or support multiple concurrent projects.

This position works closely with Kinross' project delivery teams, our project delivery partners (EPCMs), project suppliers, contractors and consultants, and site and regional management.  

JOB RESPONSIBILITIES
Oversee and guide the purchasing and contract management function in the following key roles and responsibilities:

*Sourcing analysis, market survey, and contractor pre-qualification are sufficient to recommend to project leadership an optimized project packaging and delivery strategy *Lead in the formulation, negotiation, legal review, and execution of agreements, contracts, change orders, and other contract documentation *Put in place measures to manage compliance with contractual obligations and to proactively identify potential contract changes, deviations or claims *Manage and negotiate claims and other legal actions *Ability to supervise and review the work of others performing the duties above *Conduct their activities in accordance with the highest ethical standards and Kinross' policies and procedures
EDUCATION AND EXPERIENCE
*University degree in engineering, business, finance, law with at least 5 - 8 years of experience with the formulation, negotiation and administration of complex contractual relationships, or equivalent in experience and education in mining, construction or heavy industry.  *Formal training in contract law or contract administration is an asset *Intimate knowledge of the standards and practices of the heavy construction industry *Must have demonstrated ability to provide leadership, possess management skills and be able to organize, set priorities and handle multiple complex tasks at one time *Must have strong administrative, communication, and organizational skills *Must have demonstrated ability to work independently, take initiative, and be attentive to detail *Must be able to meet deadlines and work under pressure against competing priorities and timelines *Demonstrated ability in an international business context including the ability to work effectively with teams incorporating varied different business cultures *Must have above-average ability to communicate effectively in English and a second language (Russian, Spanish or French) including the preparation of contracts, reports and other documents that require precise use of language
WORKING CONDITIONS
*The position is based in Toronto *Frequent international and domestic travel is required to project sites, offices of project delivery partners, and other locations as necessary.  Frequent interaction with various groups is central to the success in fulfilling the role.  *Project requirements will vary over time but travel will range from 25-35%.
