Staff Counsel
New York City, NY Civil Service Title: AGENCY ATTORNEY Level: 02 Title Code No: 30087 Salary: $66,326.00 / $76,275.00* *minimum with two years of continuous city service Office Title: Staff Counsel Work location: 42 Broadway, New York, NY Division/Work Unit: General Counsel’s Office Number of Positions: 1 Job ID: 361165 Hours/Shift: 9:00 AM - 5:00 PM Job Description The Office of the General Counsel at DCA seeks an experienced attorney to serve in the Staff Counsel position. Reporting to the Deputy General Counsel and Assistant General Counsel, the Staff Counsel will serve as the agency’s subject matter expert on issues related to sidewalk cafés—one of the 55 industries licensed by DCA. The Staff Counsel will oversee all legal work related to this industry, including: providing guidance to staff and management on laws, rules and related policies; addressing legal issues arising from DCA’s licensing, collections and enforcement work; undertaking legal research and analysis; drafting memoranda, correspondences and other legal documents; reviewing agency materials related to sidewalk cafés; drafting and negotiating settlement agreements with businesses; appearing before the Office of Administrative Trials and Hearings (OATH) on such matters; assisting on appeals; and communicating regularly with external parties. The Staff Counsel will also be responsible for attending meetings with City Hall, other City agencies and industry groups, as needed, as well as assisting on sidewalk café matters that are litigated in state court. The position may entail an administrative component including overseeing support staff and working closely with staff in DCA’s Licensing Division to ensure that legally mandated timeframes are adhered to. As part of all these functions, the Staff Counsel is responsible for careful case project management and operational tasks necessary to support and effectuate this work. The ideal candidate is a self-motivated, experienced attorney with superb writing and research skills. The sidewalk café work requires understanding and analysis of technical matters, including zoning and land use regulations, insurance compliance and interpretation of architectural drawings and land surveys. The ideal candidate will have experience in these areas. The sidewalk café work also requires interaction with many divisions within DCA, as well as regular contact with diverse external parties. The ideal candidate has excellent communication skills and works well in a team comprised of attorneys and non-attorneys. The position requires an individual who enjoys substantial responsibility and thrives in a fast-paced, sometimes high-pressured environment. Minimum Qualification Requirements Admission to the New York State Bar; and either "2" or "3" below. One year of satisfactory United States legal experience subsequent to admission to any state bar; or Six months of satisfactory service as an Agency Attorney Interne (30086). Note: Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment. In addition to meeting the minimum Qualification Requirements: To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. However, City Employees in certain titles who have worked for the City for 2 continuous years may also be eligible to reside in Nassau, Suffolk, Putnam, Westchester, Rockland, or Orange County. Preferred Skills Demonstrated ability to multitask, set priorities and work quickly, efficiently and independently, without sacrificing quality; Excellent written and verbal communication skills; Excellent editing skills and appreciation of rigorous standards for written work; Strong aptitude for research, due diligence and attention to detail, to ensure accuracy of work product; Impeccable legal judgment, problem solving skills and ability to resolve issues in a diplomatic and expedient fashion; Familiarity with administrative law issues; Experience with regulatory compliance; Ability to work in and direct teams in a diverse environment comprised of attorney and non-legal staff; Interest in or experience in government or public sector work; Demonstrated advocacy and negotiation skills; Litigation experience; Interest in working in a hands-on “roll up your sleeves” atmosphere; Supervisory experience, a plus; Flexibility in hours.
